Another bellwether lawsuit against manufacturer Bard is set to begin.
Another transvaginal mesh lawsuit against manufacturer C. R. Bard is set to begin next week in a federal court in West Virginia.
Court documents say the case is set to begin on December 3.
This case is the last of four scheduled bellwether lawsuits against Bard. In the first three, two ended with the plaintiffs receiving compensation for their injuries. Of those two, one ended with a jury awarding the plaintiff $2 million and in the other the plaintiff settled for an undisclosed amount of money.
These bellwether cases are intended to be an indicator of what both sides can expect in future cases. They give both sides a chance to gain insight into how remaining litigation may play out.
Bard is just one of many transvaginal mesh manufacturers who have come under fire in recent years. The mesh has been associated with a variety of problems for women, including pain, infections, difficulty urinating, and other problems.
In each previous bellwether Bard transvaginal mesh lawsuit, jurors heard how manufacturer Bard used a type of mesh made with a chemical that was never meant for permanent implantation. The case exposed how the manufacturer placed profits ahead of the safety and well being of countless women who were implant with the devices over the last several years.
These types of implants have since been identified as dangerous by the FDA, and because of the bad publicity surrounding these cases many people now identify the mesh solely for the damage it has caused in patients.
