An estimated 11,200 lawsuits are pending against Bayer over Monsanto’s controversial glyphosate weed-killer products known as Roundup. Shares in the German-headquartered Bayer, which acquired Monsanto last year, plummeted over 12 percent after a second jury in the U.S. ruled its Roundup herbicide caused cancer. This marks two consecutive plaintiff victories in the ongoing legal battle with Monsanto concerning Roundup cancer risks.  With other glyphosate cancer trials underway in courtrooms across the nation, it is very possible that Bayer will consider negotiating Roundup lawsuit settlements.

If you or a loved one were diagnosed with non-Hodgkins lymphoma or another type of lymphatic cancer after Roundup exposure, you may be entitled to legal compensation. Showard Law Firm extends free consultations to individuals who believe they may qualify for Monsanto lawsuit settlements. Judge in favor of Roundup lawsuit settlements

Legal experts say that additional verdicts in favor of plaintiffs in Roundup bellwether trials would provide their counsel leverage in any settlement talks for the remaining lawsuits before Judge Vince Chhabria, who is presiding over the multidistrict litigation in California federal court. Chhabria has scheduled two additional bellwether trials this year, the outcomes of which are being closely monitored. The judgements rendered in these preliminary cases indicate how a panel of jurors are likely to respond to hundreds of cases that have similar issues of fact and legal arguments.

Last month, the honorable Judge Chhabria told legal counsel for Bayer and plaintiffs in the MDL that both sides should enter mediation to discuss Roundup lawsuit settlements.

Anyone who has used Monsanto’s glyphosate-based weed killer and developed cancer, such as non-Hodgkin’s lymphoma, may qualify for litigation against Bayer AG.

Do you qualify for Roundup cancer lawsuit settlement?

In Roundup trials thus far, jury members have agreed with plaintiff allegations that Monsanto failed to warn consumers of the increased risk of cancer from glyphosate. Jurors have also found that Monsanto’s Roundup likely causes certain lymphatic cancers like non-Hodgkin lymphoma.

Although it is too early to predict whether Bayer will negotiate a global settlement, it is clear the company is under pressure for the health risks posed by its weed-killing products.

There is no way to predict the exact dollar figure Bayer might agree upon to settle a lawsuit, but a number of factors will be taken into consideration.

  • The type and severity of cancer developed by the plaintiff
  • Past and future medical expenses incurred to treat their disease
  • Loss of wages or earnings due to their injury
  • Loss of quality of life
  • Loss of future earnings
  • Pain and suffering in cases where the cancer is terminal

Any verdict or settlement may also include punitive damages, which are meant to punish the defendant for particularly egregious and wanton conduct.

Monsanto roundup cancer verdicts

The first Roundup cancer trial resulted in a $289 million verdict against Monsanto, after jurors found the defendant failed to warn about the risks posed by glyphosate. The San Francisco jury awarded the plaintiff, who was diagnosed with lymphoma, $33 million in compensatory damages and a stunning $250 million in punitive damages, though a judge later reduced the award to $78 million.

The second bellwether case, brought by Edwin Hardeman who developed non-Hodgkin lymphoma after using Roundup for years, also prevailed. Hardeman won an $80 million verdict against Monsanto, which the company plans to appeal.

As countless people across the United States claim that Monsanto engaged in deceptive practices in the marketing of its popular weed killer, the company and Bayer stand behind the safety of Roundup and appeal both court decisions.
